Notice Of Public Hearing By The Orange County Board of Supervisors

Proposal:  The Esperanza Hills Project (PA120037) proposes a General Plan Amendment from 5 Open Space to 1B Suburban Residential and a Zone Change from A1 Agricultural and A1-(O) Agricultural with an Oil Production Overlay to S Specific Plan, and adoption of the Esperanza Hills Specific Plan in order to develop the property.  The Project proposal is to construct a 340 unit gated community with large lot, low density residential neighborhoods on approximately 469 acres with an overall density of 0.73 dwelling units per acre.  Once developed, approximately 62 percent of the project will be open space, parks and landscaped areas.

Notice of Availability of a Draft Subsequent Environmental Impact Report for the Lakeview Apartments

45-DAY PUBLIC REVIEW PERIOD: May 10, 2015 to June 23, 2015

Pursuant to Public Resources Code Sections 21165 and 21166, and the California Environmental Quality Act Guidelines (CEQA Guidelines) Section 15050, the City of Yorba Linda (City) is the Lead Agency responsible for preparation of a Subsequent Environmental Impact Report (SEIR) addressing potential impacts associated with the proposed Lakeview Apartments (site development plan, Tentative Tract Map 17784, and Design Review 2013-16).

Project Location. The 4.99-acre project site is generally located southeast of the intersection of Lakeview Avenue and Mariposa Avenue, just north of Orchard Drive at the southern boundary of the city of Yorba Linda. Surrounding land uses consist of single family residences to the north within the city of Yorba Linda; multifamily and single family to the west (across Lakeview Avenue) within the city of Placentia; single family residences to the south (across Orchard Drive) within the city of Anaheim; and undeveloped open space (the dry Yorba Linda Reservoir, commonly referred to as the “Yorba Linda Lakebed”) within the County of Orange.

Project Description. The Lakeview Apartments project includes the development of 149 apartment units: 139 market-rate units and 10 affordable units. The units would be housed in four buildings, which would range in height between two and three stories. All four buildings would be constructed over one or two levels of enclosed parking structures. Other project components include a leasing office, multipurpose room, and three common open space and recreation areas, which would feature a tot lot; fitness center; lap pool and Jacuzzi; outdoor lounge area with seating; and half-court basketball court. The proposed project would require removal of existing mature trees, shrubs, and other on-site vegetation. The proposed project would include modifications to the existing, operating oil production wells onsite.

The project description provided in the 2011 Addendum to the Yorba Linda 2008-2014 Housing Element and Implementation Programs Final Environmental Impact Report (Program EIR) (State Clearinghouse No. 2010051079) was incorrect in identifying Site No. 14 (the Modified Project site), recognizing it as 0.34 acre and without reference to the boundaries of the site. Part of the Modified Project would be to correct the previously certified Program EIR, as updated by the 2011 Addendum, to indicate the correct acreage and density allowed, and thus the number of units to be developed on Site No. 14.

Environmental Determination. The City of Yorba Linda has completed a Draft Subsequent Environmental Impact Report (Draft SEIR) for the Lakeview Apartments project. The Draft SEIR analyzed the environmental impacts to the following study areas: 1) Aesthetics, 2) Biological Resources, 3) Geology and Soils, 4) Noise, and 5) Transportation and Traffic. The Draft SEIR determined that the project would result in significant impacts to 1) Biological Resources, 2) Geology and Soils, 3) Noise, and 4) Transportation and Traffic. One traffic impact relating to construction traffic would remain significant and unavoidable after mitigation measures are applied during an interim condition. Impacts to aesthetics were found to be less than significant.

A subsequent EIR has been prepared for this project because substantially the same project was previously approved and analyzed as part of the City’s 2008-2014 Housing Element and Implementation Programs in a Program EIR (SCH 2010051079) adopted in 2011, as updated by the 2011 and 2013 Addenda. Since that time, the project applicant has submitted plans to develop 149 apartment units requiring the approval of a site development plan, tentative tract map (TTM 17784), and design review. These changes to the project resulted in major EIR revisions pursuant to State CEQA Guidelines Section 15162(a) requiring preparation of a subsequent EIR. Those changed circumstances include increased impacts related to aesthetics, biological resources, hazards and hazardous materials, and noise. Since public concern was raised regarding transportation and traffic, the City also included updates to that impact area.

Notice of Public Hearing. Notice is hereby given that the Planning Commission and Traffic Commission will hold a joint public hearing to consider input from the public on the Draft SEIR. The meeting is scheduled on:
